Artsetter respects the rights of all artists and creative people worldwide. It is most likely that all the artworks and articles that you see on the site are copyrighted. To give you some more information on Copyright law we have answered some frequently asked questions. This document is for educational purposes only and should you require legal advice, you must contact a qualified attorney.
On Artsetter, Artists may only sell and expose their own original artworks. If you own an artwork but it is not your creation, you cannot sell it through Artsetter.
The copyright of artworks on Artsetter is one of our main concerns and we work hard to ensure that Artsetter Artists’ Artworks are fully protected.
What does Artsetter do to protect the copyright of its artists?
Artsetter has put into place several ways of protecting our sellers and buyers:
* The photos of Artist’s artworks are uploaded onto the site using Flash technology (this means that one cannot save or copy/paste the picture directly from the site)
* Each photo of an artwork is associated directly with its creator.
* Each time a photo of an artwork is uploaded the artist is required to say whether he/she has provided an authenticity certificate
If you feel that you have been a victim of a copyright infringement, Artsetter can provide you with the information necessary to carry out your claim (ex. the time and date that you uploaded certain artworks)
What is Copyright Infringement?
To simplify this question, copyright infringement occurs when you do certain things with a creative work which someone else produced without first getting the proper permission.
Some examples of copyright infringement (this is only a partial listing) can include:
* Placing a photograph or creative work online without proper permission.
* Using a creative work commercially that you did not create.
* Adapting a creative work of one medium to another, such as making a photograph into a painting.
* Modifying or editing a creative work without proper permission.
How Can I Avoid Infringing on Someone's Copyright?
To avoid infringing on someone’s copyright, the artworks or articles that you upload onto Artsetter need to have been created by you. This means that they must be your own original work.
If you have used materials in your artwork which are owned by other people or companies make certain that you have obtained proper permission or licensing for the use before you place your work online. If you have written an article you must reference all your sources.
What Sort of Things are Copyrighted?
Any creative work that you find on Artsetter, whether it be an artwork or an article, should be considered to be copyrighted by default.
A work is not required to have a copyright statement printed on it or near it in order to be considered copyrighted so do not assume that the work is unprotected simply because you cannot see a notice written anywhere.
Though a work is publicly available do not think that it is public domain or free for use. Being easy to find on the internet does not affect a work's copyrighted status.
What Happens When You Submit Infringing Works to Artsetter?
When we become aware that an artwork submission to Artwork infringes upon the copyrights of another artist, creative person or company, we will immediately delete it. This is a legal requirement which we fulfill immediately; you will not receive an advanced warning and you will not be given an opportunity to 'fix it'.
If you take my infringing work down am I protected from a lawsuit?
No. When Artsetter takes off an infringing work from the website it does not mean that you are protected if a copyright owner decides to sue you. You may still be held responsible for significant damages.
How do I report copyright or intellectual property infringements on Artsetter?
Beforehand you should know that if you materially misrepresent that a product or activity is infringing your intellectual property, you will be liable for damages (including costs and attorneys’ fees).
